OFFICIAL RULES (the “Official Rules”)
NO PURCHASE IS NECESSARY TO ENTER OR WIN. The sweepstakes (the “Sweepstakes”) is open only to legal residents of the Continental United States. This sweepstakes will be construed and evaluated according to applicable United State law. Void where prohibited by law. Sponsored by Chriselle Inc (address available upon request) (“Sponsor”). To enter: (1) entrant must be a follower of @chrisellelim on Instagram at the time of entry; (2) entrant must post a public comment on Chriselle Lim’s Instagram @chrisellelim tagging a friend and using the hashtag #getincinc; and (3) entrant’s tagged friend must then follow @chrisellelim on Instagram (“Entry Requirements”). To be eligible, entries must meet all Entry Requirements and will be accepted only after the official announcement of the start of the Sweepstakes on the @chrisellelim Instagram account and before the end of the Sweepstakes on June 20, 2017 at 9am PST (the “Sweepstakes Period”). Must be age 18 or older to enter. One (1) entrant shall be selected as the winner (the “Winner”) by random draw. Odds of winning depend on the number of entries received. Winner will be notified by Sponsor on June 20, 2017 via Instagram direct message, and will have twenty-four (24) hours to respond to the Instagram direct message and accept the prize by: (1) providing the information about Winner and their tagged friend requested in the Instagram direct message to enable prize travel and activities, which may include, without limitation, email addresses, legal names, dates of birth, home addresses, any relevant dietary restrictions or food sensitivities, and any other reasonable health restrictions and (2) by Winner and their tagged friend each signing and returning a waiver of liability form acceptable to Sponsor (“Acceptance Procedures”). Any winner failing to timely meet the Acceptance Procedures shall forfeit their prize and the prize for their tagged friend, which may then be awarded to another entrant and their tagged friend at Sponsor’s sole discretion. Winner shall receive a prize consisting substantially of the following: (1) round trip coach airfare travel for Winner and Winner’s tagged friend to Los Angeles, CA (approximate retail value $500.00-$750.00 per ticket); (2) One hotel room shared between Winner and Winner’s tagged friend in Los Angeles, CA for one (1) night (approximate retail value $600.00); Any additional hotel amenities, purchases, requests, damages or anything thereafter shall be the financial responsibility of Winner and or Winner(s) tagged friend. Winner shall provide a valid credit card upon checking into hotel to ensure the prior (3) $100.00 cash towards ground transportation for Winner and Winner’s tagged friend (approximate retail value $100.00); (4) Food and meals for Winner and Winner’s tagged friend for one (1) day provided by Chriselle Inc (approximate retail value $60.00 per person); (5) two (2) gift bags, one for Winner and one for Winner’s tagged friend (approximate retail value $450.00 per gift bag); and (6) a shared photography session for Winner and Winner’s tagged friend with a photographer (approximate retail value $250.00) (all of the foregoing the “Prize”). The travel dates for the Prize are July 13, 2017 to July 14, 2017. The Prize is non-transferable and no substitutions are permitted, except at the discretion of Sponsor. Winner and their tagged friend guest are each solely responsible for any state or federal taxes incurred by receiving the Prize and for any costs of travel not specifically listed in the Prize. By entering the Sweepstakes or accepting any prize, entrant and entrant’s tagged friend agree to release, discharge, defend, indemnify and hold the Sponsor and their respective officers, directors, employees, representatives and agents harmless from and against any claims, damages, losses or liability due to any injuries, damages or losses (including death) to any person or property of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of any prize or participation in any prize related activities or participation in this Sweepstakes including any and all costs and attorneys’ fees incurred in responding to and/or defending such claims. Sponsor shall not be liable to Winner or Winner(s) tagged friend for failure to supply the prize by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid; equipment failure; terrorist acts; air raid; blackout; act of public enemy; earthquake; war (declared or undeclared); fire; flood; epidemic; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor’s sole control. The Sponsor is not responsible for: (i) entries or votes that are lost, late, stolen, damaged, garbled, destroyed or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries/votes, or for destruction of or unauthorized access to, or alteration of, entries/votes; (iii) failed or unavailable hardware, network or, software; (iv) causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes; (vi) any typographical or other error in any printing or advertising related to the Sweepstakes, in the administration or execution of the Sweepstakes, or in the announcement of the winners; (vii) cheating or fraud by any entrant or voter; or (viii) any modification or cancellation of the Sponsor’s marketing initiative. If for any reason this Sweepstakes cannot be executed as planned, Sponsor reserves the right to terminate this Sweepstakes with no further legal responsibility to either Entrants (S) and or Winner (S). Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or any aspect of this Sweepstakes. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. Except where prohibited, entrant and entrant’s tagged friend agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant or entrant’s tagged friend be permitted to obtain awards for, and entrant and entrant’s tagged friend hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
